okay, okay...may I be so bold and to ask everyone's opinion/thoughts on this particular topic? Yeah, it's an assignment...and I have my own thoughts but wanted to pick at your brains as well for some additional feedback. Below is the incident story...read it (re-read it if you must) and let me know what you think by answering the three questions. Fire away ;)
1. Is Peter a victim of discrimination?
2. Evaluate the branch manager's comment that Peter would not have been hired had he worn the earring during the employment interview.
3.Evaluate South Town's dress policy. Is it clear? Is it appropriate? Is it legal?

i dont think he was discriminated, or should i say i dont think he has a case against his former employer. he was asked twice to remove the earing, not until he refused twice, was he fired. also, the handbook says "visible jewelry must be small and tasteful as determined by management . the manager asked him once, peter refused and cited that the women could wear earings, the manager asked again, peter refused again. only then was he fired. peter never stated that the earring was a religious, cultural, or political item. he never said anything about why he wears it. .. okay, so that's what i think, for what it's worth.
Every company has it's own dress code and he, as an employee, should follow that dress code. If he doesn't like that policy then he should look for one that doesn't care what he wears to work. It's just a piece of earring for God's sake and this guy obviously has a thing against authority.

I completely in favor of what J has said. It's not discriminatory to Peter because it is the policy of the company. Given the chance to dress down on weekends is already a plus bonus. An earrings (inspite the popularity of men wearing them as trends) is totally unappropriate at work. It is a reputation of the Company to have a good grooming and they cannot tolerate someone wearing a bling. A first impression on how you wear business clothes is a must. I would say NO to golf too since I don't play this millionaire's lifestyle might as well just keep the business-day clothes in place.
Well, here in Norway I saw some guys who are working in the office or even in the government with earrings and sometimes pierced eyebrows and also pierced nostrils for the women.
He was not discriminated against. For him to have a case of discrimination, he would have to prove that he was forced to remove the earring due to his nationality, skin color, sexual preferance, etc. However, with the trends being the way they are , there should have been something specifically listed in the policy that addresses male jewelery, so I do not find the policy to be completely clear in this case.
i feel that his earrings are not very discreet since it's a gold loop. a stud may have suffice. anyway, the company has it's own image to uphold, and being part, it is but his duty to abide by it. (im sure he has prior knowledge how conservative the company is). he tried to push his luck, but unfortunately it backfired. The thing is, due process should've been given or perhaps a much lighter disciplinary action like suspension or forced leave.

J..I got the full 100 points ;P here are my answers for each question: 1. I do not believe that Peter was a victim of discrimination. For him to have a case of discrimination, he would have to prove that he wears the earring due to a fundamental observance of his religion and the company fired him without making an attempt to accommodate him. Grooming policies that reflect customary modes of grooming have insignificant impact on employment opportunities and I don't consider it to represent discrimination. This was not a case of religious justification and the Bank has the right to impose such a dress code that will uphold a reasonable level of professionalism. Peter as an employee should follow that dress code because the way a person dresses, overall appearance and attitude will be the factors on which people base their first impression of you. You have only one chance to make a first impression and you definitely want to make it a good one. Then again, I feel Peter should not have been fired but instead given a verbal warning first that he could be sent home to have it removed or he had until the end of the day to have it removed. If he was found wearing the earring again the following day, a recommendation for his suspension or dismissal would be submitted. 2. I believe the branch manager's comment was unfitting as well as improper and probably caused by the awkward situation he was placed in. He should not have said that Peter would not have been hired but rather he should have said had Peter worn the earring during the employment interview, Peter would have been explicitly informed about the bank's employee dress policy that he would not be able to wear it. Likewise, the branch manager could have said this as an alternative, "What you wear on your own time is your business and I'm not judging that. What I'm concerned about is your credibility and image as well as that of the company." Peter must understand that it is a company policy; no exceptions and not wearing the earring must be met in order for Peter to accept and keep the job. If he is employed to represent their bank to the general public, visible pierced body parts like an earring can adversely affect their ability to promote the bank's best interests. 3. Despite an apparent trend towards more freedom of expression in dress in today's society, many employers have kept dress codes. I find South Town's dress policy is a bit ambiguous and leaves it open for much interpretation. What one manager deems proper may not hold true with another manager and the standard is not clear. Instead a change to the company's dress policy should be made where it will state and evenly enforced grooming standards for male and female employees under categories like hair, makeup facial hair, tattoo and jewelry or piercing. For example it should state no earrings on men and only one earring per ear for women. It is a bank and banks have traditionally been a place where people expect a degree of conservatism so I think it is appropriate for them to base dress policy choices on the presumption that employees at all levels and job positions are representatives of the bank and, therefore, their dress, grooming, and personal hygiene affect both the public's impression of the business professionalism and internal morale. In the case of individuals with piercings, there is no law that offers them specific protection from employment discrimination on the basis of their appearance because employers are free to set sensible dress codes and grooming standards that are business-justified and applied in a nondiscriminatory manner. yeah...how I can totally BS for my answers :P
